TERMS AND CONDITIONS

Subject:
As part of the opening of our Santa Catalina branch, we are raffling off a "Tomo Gold Card", which entitles the winner to one free meal daily at our branch for a period of one year (365 days).

Prize Period:
February 14, 2026 to February 13, 2027 (365 days)

Number of Winners:
Exactly 1 (one) winner will be selected.

Draw Date:
The draw will take place live on February 14, 2026, during our Grand Opening event and will be streamed via Instagram.

2. Eligibility

Participation is open exclusively to natural persons who meet the following requirements:

  • Minimum Age: 18 years at the time of participation
  • Residence: Resident in a European Union country
  • Exclusions: Employees of Tomo Tolu SL, their relatives, and business partners directly connected to this raffle are excluded from participation.

A valid proof of age (ID card or passport) must be presented upon prize handover.

3. Participation Mechanics

Participation in the raffle is possible in two ways:

Option A: Participation via Instagram

  1. Open the Instagram post about the raffle
  2. Like the post and follow the account @tomotime.food
  3. Receive an automatic direct message (DM) with data request
  4. Submit the following mandatory information in the DM:
    • Full Name (First and Last Name)
    • Phone Number
    • Email Address

Important: The terms and conditions are transmitted together with the automatic direct message. By submitting contact details, the participant agrees to these terms and conditions.

Option B: Participation via the Website

  1. Visit the raffle page at www.tomo-food.com/raffle/https://tomo-xmas.netlify.app
  2. Completely fill out the contact form with:
    • Full Name (First and Last Name)
    • Phone Number
    • Email Address
  3. Check the box to confirm acceptance of the terms and conditions
  4. Submit the form

Participation Period

Participation is possible from December 2, 2025, 00:00, until February 13, 2026, 23:59 (CET).

Multiple Entries

Only one entry per person is permitted. Multiple entries will be identified by email address and name and will lead to exclusion from the raffle.

4. Winner Selection and Notification

Draw

The winner will be selected by random draw from all valid entries. The draw will take place on February 14, 2026, during the Grand Opening event at the Santa Catalina branch and will be broadcast live on Instagram.

Notification

  • Winner on site: The winner will be announced directly on site and notified personally.
  • Winner not on site: The winner's Instagram name will be displayed in the live stream. The winner will be asked to contact Tomo.
  • Email Notification: Additionally, a written notification via email will be sent within 48 hours after the draw.

Acceptance Period

The winner has 14 days from receipt of the notification to accept the prize. If there is no response within this period, the claim to the prize expires without substitution. In this case, a replacement draw will take place among the remaining participants.

5. Prize Description

The prize includes:

  • 1 Tomo Gold Card valid for 365 days from the date of issue
  • Daily 1 full meal consisting of:
    • 1 Tomo of choice (Tomo Rolls, Classic Tomo, or other available bowl variants)
    • Up to 2 toppings of choice

Validity Area:

  • The card is redeemable exclusively at the Santa Catalina branch (Plaça de la Navegació, 17, Palma)
  • The card is valid during the respective opening hours of the branch (breakfast and regular food service)
  • Maximum of 1 meal can be redeemed per day

Not included in the prize:

  • Drinks (must be paid for separately)
  • Additional meals on the same day
  • Side dishes or extras outside the standard menu
  • Delivery service options

Limitations:

  • No Cash Payment: The prize cannot be paid out in cash or exchanged for other goods or services.
  • Non-transferable: The card is intended exclusively for the winner personally and may not be passed on to third parties.
  • No Special Requests: Special requests or allergy adjustments that go beyond the regular standard menu cannot be taken into account.
  • Temporary Closures: In the event of temporary closures due to renovations, the validity of the card will be extended by the corresponding number of days. Closures due to force majeure or public holidays are excluded from this.
  • Business Closure: In the event of business closure or insolvency of Tomo Tolu SL, the claim to the prize expires without substitution and without claim to compensation.

6. Prize Handover and Identification

Handover of the Gold Card

The Tomo Gold Card will be handed over personally at the Santa Catalina branch by appointment.

Proof of Identity

A valid ID document (ID card or passport) must be presented at the handover. Identity will be verified against the data provided at participation.

Alternative Handover Options

If personal collection is not possible for the winner, an alternative handover option can be requested via email to eu@tomo-food.com within 14 days of notification. Tomo Tolu SL reserves the right to examine such requests on a case-by-case basis and to approve or reject them at its own discretion. Any alternative solution is provided solely as a courtesy and will only be considered if it is legally and organizationally easy to implement.

Non-appearance

In case of non-appearance within the acceptance period, the claim to the prize expires without substitution.

7. Abuse and Card Blocking

Cases of Abuse

Abuse of the Tomo Gold Card exists in particular in the following cases:

  • Multiple use of the card on the same day
  • Passing the card to third parties
  • Attempting cash payment or selling the card
  • Taking meals for non-present persons on a large scale

Consequences

If abuse is determined, the card will be blocked immediately and without substitution, without claim to compensation. Tomo Tolu SL reserves the right to block the card in case of justified suspicion of abuse and to request a statement from the winner.

8. Data Protection (GDPR)

Collection and Processing of Personal Data

The following personal data is collected for participation in the raffle:

  • First and Last Name
  • Phone Number
  • Email Address
  • Instagram Handle (only for participation via Instagram)

Purpose of Data Processing

Data processing is carried out exclusively for the purpose of conducting and handling the raffle, in particular for winner selection, notification, and handover.

Storage Period

Personal data will be stored until revocation of consent or until a deletion request is asserted. Deletion of data can be requested at any time via email to eu@tomo-food.com.

Email Marketing (Optional)

With separate consent, participants can sign up to receive product news and Tomo news via email. This consent is completely voluntary and has no influence on participation in the raffle. Consent can be revoked at any time by clicking on the unsubscribe link in every email.

For participation via Instagram: Consent for email marketing can be given by replying to the automatic DM.

For participation via Website: An optional checkbox allows separate consent for email marketing.

Rights of Data Subjects

Every participant has the right to information, correction, deletion, restriction of processing, data portability, and objection. These rights can be asserted at any time via email to eu@tomo-food.com.

Transfer to Third Parties

Data is not passed on to third parties unless there is a legal obligation to do so.

9. Image Rights and Public Relations

Voluntariness

On the day of the prize handover, the winner will be asked if they wish to participate in photo or video recordings for social media and marketing purposes. Participation is completely voluntary and can be refused without giving reasons. Refusal has no negative impact on the prize.

Use upon Consent

If consent is given, photo and video material of the prize handover may be used for social media channels and marketing materials of Tomo Tolu SL. Publication will be made using the first name (without last name), unless otherwise desired.

Revocation

Consent to the use of image and video material can be revoked at any time with effect for the future.

10. Disclaimer

Tomo Tolu SL is not liable for:

  • Technical malfunctions during participation via Instagram or the website (e.g., server failures, connection interruptions)
  • Events of force majeure (e.g., natural disasters, supplier failures, official orders)
  • Health consequences due to existing allergies or intolerances – the winner is responsible for informing themselves about ingredients and, if necessary, refraining from redeeming the card

Liability for intent and gross negligence remains unaffected.

11. Premature Termination and Changes

Tomo Tolu SL reserves the right to:

  • Terminate the raffle prematurely in the event of legal violations or for other important reasons
  • Adjust the opening hours of the branch due to operational necessities (start-up flexibility)
  • Adjust the menu composition seasonally or due to the availability of ingredients

Guaranteed to remain unchanged:
The prize period of 365 days from the date of issue of the card (plus extensions for renovation closures).

12. Applicable Law and Jurisdiction

This raffle and all claims arising from it are governed exclusively by the law of the Kingdom of Spain. The place of jurisdiction is Palma de Mallorca. Legal recourse is excluded to the extent permitted by law.

13. Social Media Disclaimer

This raffle is not connected to Instagram, Meta Platforms Inc., or other social media platforms. Instagram/Meta is not liable for the raffle and is not a sponsor or involved in any other way.
